(1) If there is a provision for appointing a conciliator in the contract, the conciliator shall be appointed in accordance with the same and if there is no such provision, the conciliator shall be appointed in accordance with this Act.
(2) When appointing a conciliator in accordance with sub-section (1), the parties shall make the appointment by mutual consent.
